Pre-arrest bail in Pakistan can protect a person from arrest while a court examines the case against them.

If you fear arrest in a criminal case, pre-arrest bail may protect you while the case is examined. It is not automatic, and courts treat it as an extraordinary remedy.
Pre-arrest bail, also called bail before arrest, is sought under section 498 of the Code of Criminal Procedure, 1898. It protects a person from being arrested in a particular case, usually first on an interim basis and then through a confirmation hearing.
Courts generally look for:
The accused usually has to appear personally before the court.
Once arrested, a person may seek bail under section 496 for bailable offences or section 497 for non-bailable offences. Section 497 contains a prohibitory clause for offences punishable with death, life imprisonment or ten years’ imprisonment. It also makes special provision for certain categories, including women and children, and applies different considerations if further inquiry is needed.
Getting interim bail does not end the case. The police can continue to investigate, and the accused is normally expected to join the investigation when asked. Refusing to cooperate can seriously damage the application at the confirmation stage.
The court reviews the record and hears both sides. The complainant’s counsel may oppose bail. If the court confirms bail, the protection usually continues during the trial, subject to the conditions imposed. If it refuses, the accused may be arrested, and further remedies should be considered at once.
After the investigation, the police submit a report, known as a challan, and the case goes to trial. Bail granted before arrest may need to be continued before the trial court. Check the court order and speak with your advocate so that nothing lapses.
A surety is a person who promises the court that the accused will attend. The court sets the amount, and the surety usually provides documents showing identity and means. If the accused fails to appear, the bond may be forfeited, so a surety should understand this risk before signing.
Section 497 contains a proviso allowing courts to release certain accused persons, including women, children and sick or infirm persons, even in serious cases, subject to its terms. Each case still depends on its facts.
Pre-arrest bail in Pakistan is not automatic. Act quickly, attend every hearing and join the investigation. Anyone seeking pre-arrest bail in Pakistan should arrange a surety and have copies of the case papers ready.
